On November 15, 2024, a federal judge in the Eastern District Court of Texas has ruled against the Fair Labor Standards Act (FLSA) overtime final rule. This ruling invalidates all aspects of the rule, including the salary thresholds for July 2024 and January 2025, and also cancels the triennial automatic updates. The decision is applicable to all employers and employees covered by the FLSA across the nation. As a result, Systemwide Academic Personnel will be pausing the implementation of the FLSA salary basis test change effective January 1, 2025, for academic appointees systemwide. Further official communication will be forthcoming in the next couple of weeks.
